Wallis of a plea of Trespasse upon the case

And wherupon the sd Richard Wallis by W.m Hemsley his Att.ry
complaineth that Wheras the sd Robert Davenish on the 30.th day
of May Anno Dom 1697 in the sd County within the Jurisdicon of
this Court stood Justly indebted unto the said Richard Wallis in the
full and just sume of Two Thowsand Five hundred Ninety and six
poundes of good sound M.rchantable Tobaccoe in caske by accompt
the perticulers therof and here in Court brought in Consideracon
wherof the said Robert upon himselfe Assumed And to the said
Richard he faithfully promised that he the sd Robert the said sume
of 2596.ll of Tobaccoe unto the said Richard would well and truely
pay when therunto required Yett Neverthelesse the said Robert the
sd sume of 2596.ll of Tobaccoe according to his promise and Assumption
aforesd unto the said Richard he hath not paid alltho often
required but the same to pay he hath denied and refused to the
damage of the said Richard Five Thowsand poundes of Tobaccoe
and therupon he brings this suit

Therfore it is considered by this Court that the Plt Richard
Wallis doe Recover from the Defend.t Robert Davenish the
said sume of six hundred Fifty and One poundes of Tobaccoe

Command was Given to the Coroner of Kent County y.e 26.th day of
March Anno Dom 1697 that he take Elizabeth and Thomas Coursey Ex.rs
of Coll Henry Coursey if they should be found in his Bailiwick &
them safe Keepe soe that he have their Bodies before his Maj.ties Justices
att the Next Court to Answer unto Edw Sweatnam of a plea of Tre sur Ca
att which Court viz the 22.th day of June Anno Dom 1697 the day
of Returne of sd Writt came Maj.r Thomas Smith Coroner of sd
County and made Returne of said Writt in these words viz Thomas
Coursey Cepi Corpus Elizabeth Coursey non Est inventus
