to the liberties and privilidges accustomed of a plea of Trespasse upon the case And wherupon the said William in his proper person complains and saith that whereas the said Rennatus the 30.th day of November Anno Dom 1696 in sd County within the Jurisdicon of this Court stood justly indebted to the said William in the full and just sume of Fifteene hundred poundes of Tobaccoe p Accompt the perticulers therof are here in Court brought in consideration therof the said Rennatus upon himselfe Assumed and to the said William faithfully promised that he the said Rennatus the said sume of 1500.ll of Tobaccoe when therunto required would well and truely pay Yett Neverthelesse the said Rennatus the said sume of 1500.ll of Tobaccoe according to his promise and Assumption aforsd unto the said William he hath not paid alltho often demanded but the same to pay he hath denied and refused to the damage of the said W.m Three Thowsand poundes of Tobaccoe and therupon he brings this suit P.ro Persona pledges &c.a Jn.o Doe Ri Roe
And the Defendant Demurs in Law Macklin The Plt saith the Declaracon is good and prayes Judgment Hemsley p se Which Demurrer being Argued the Court give Judgm.t that the said Demurrer is good in Law wherupon the said Defend.t moves for a Non suit which is accordingly granted Therfore it is considered by this Court that the Defend.t Rennatus Smith doe Recover from the plt William Hemsley as well the sume of Fifty poundes of Tobaccoe ^for a Non suit^ as allsoe the sume of Two hundred Thirty and Nine poundes of Tobaccoe cost of suit Simon Wilmer Clk
