Att which Court viz the 22.th day of June Anno Dom 1697 the
day of Returne of said Writt came Capt Edward Sweatnam
high sheerif of said County and made Returne of said Writt
in these wordes viz Cepi p Edw Sweatnam sheft

On which day came the said Thomas Collins by Michael Earle
his Attorney and prayes therof to Imparle untill next Court wh
which was granted the same day was given to the plt allsoe

And now here att this day viz the 25.th day of August Anno Dom
1697 came the said John Chaires by Richard Macklin his Attorney
as allsoe the said Thomas Collins by Michael Earle his Attorney and
the said Accon standing for Tryal

Collins late of Talbot County Gent was summoned
to Answer unto John Chaires of a plea that he render unto him the
full and just sume of Twelve hundred poundes of good sound M.rchtable
Tobaccoe in cask which to him he Oweth and from him he unjustly
deteineth

And wherupon the said John Chaires by Richard Macklin Att.ry
saith that wheras the said Thomas Collins on the 22.th day of April
Anno Dom 1695 in said County within the Jurisdicon of this Court by
his certain writing obligatory sealed with his seale as his Act and deed
delivered and here in Court brought whose date is the same day and
Yeare did acknowledge himself to be holden and stand firmely bound
unto the said John Chaires of the same County and Province aforsd his
Heires Ex.rs Adm.rs or Assignes in the just and full sume of Twelve hundred
poundes of good sound M.rchantable Tobaccoe in cask to containe the
same to be paid att or upon the 10.th day of October next Ensueing
the date of the same bill to be paid convenient in Chester River
to the paiemt wherof the said Thomas did bind himselfe his Heires Ex.rs
Adm.rs or Assignes Yett Neverthelesse the said Thomas the said Thomas
the said sume of 1200.ll of Tobaccoe quallified as aforesd according to
the Ten.r of the same writing obligatory unto the said John he hath
not paid alltho often demanded but the same to pay hitherto he hath
denied and refused and still doth deny and refuse to the damage of
