good sound M.rchantable Tobaccoe in cask which to them he oweth
and from them he unjustly deteineth

And Whereupon the sd plts by Richard Macklin their Att.ry saith
that whereas the said Thomas Collins on the 22.th day of Ap.ll
Anno Dom 1695 att Chester River within the Jurisdicon of this
Court by his certain bill or Writing obligatory sealed with his
seale as his Act and deed delivered and here in Court brought
whose date is the same day and Yeare did bind himselfe his
Heires Ex.rs and Adm.rs to pay unto the said Peter Paggen of the
City of London M.rchant and Comp.a their Heires Ex.rs Adm.rs or
certain attorney the full and just sume of 474.ll of Tobaccoe
quallified as aforesd convenient in Chester River by the Tenth
day of October then next Ensueing the date of the same bill Yett
Notwithstanding the said Thomas Collins the said sume of 474.ll
of Tobaccoe according to the Ten.r of the same Bill unto the said
Plts he hath not paid but the same hitherto to pay hath denied &
refused and still doth deny and refuse to the damage of the sd Plts
948.ll Tobaccoe and therupon they bring this suit

no other objection Judgm.t is Awarded for sd sume of 474.ll of Tobaccoe

Therfore it is considered by this Court that the Plts Peter
Paggen and Comp.a doe Recover from the Defend.t Thomas Collins
as well the said sume of Four hundred seaventy and four poundes
of Tobaccoe as allsoe the sume of Two hundred and Nineteene
poundes of Tobaccoe cost of suit

of March Anno Dom 1697 that he take Thomas Collins if he should
be found in his Bailiwick & him safe Keepe soe that he have
his Body before his Maj.ties Justices att the next Court to Answer
unto John Chaires of a Plea that he render them the full and just
sume of Twelve hundred poundes of Tobaccoe which &c.a
