promised that he the said John Hues the aforesd sume of
272.ll of Tobaccoe in the Writing aforesd menconed unto the
said John Hawkins when therunto he the sd John Hues should
be required he would well and truely pay Neverthelesse the said
John Hues his promise and Assumption aforesd not minding or
regarding but plotting and contriveing him the said John
Hawkins craftily and subtilly to defraud and deceive the
aforesd sume of 272.ll of Tobaccoe unto the aforesd John Hawkins
Hawkins according to his promise and assumption theron as
aforesd he hath not paid alltho to doe the same the 28.th day of
November Anno Dom 1696 and att divers times before and after
att Chester River in Kent County within the Jurisdicon of this
Court he was therunto required by the said John Hawkins but
the same to pay he the said John Hues doth deny to the damage
of the said John Hawkins Five hundred poundes of Tobaccoe
and therupon he brings this suit

And the Defend.t John Hues by W.m Hemsley his Att.ry makeing
it appeare that he had paid of the said Debt Eight poundes of
Tobaccoe being overpaid in the foregoeing Accon Judgment is
Awarded for the Ballance being 264.ll of Tobaccoe

Therfore it is considered by this Court that the Plt John Hawkins
doe Recover from the Defend.t John Hues as well the aforesd
sume of Two hundred sixty and Fowr poundes of Tobaccoe
as allsoe the sume of Three hundred sixty and seaven pounds
of Tobaccoe cost of suit

of Jan.ry Anno Dom 1696 that he take Hugh Marsh if he should
be found in his Bailiwick and him safe Keepe soe that he have
his Body before his Maj.ties Justices att the next Court to Answer
unto Sarah daniel and John Toaes of a plea of Trespasse upon
the Case
