Therfore it is considered by this Court that the Defend.t John
Hues doe Recover from the Plt John Hawkins as well the
sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the
sume of One hundred and Seaventy poundes of Tobaccoe cost
of suit

Command was Given to the sheerif of Kent County the 28.th
day of Jan.ry Anno Dom 1696 to take John Hues if he should be
found in his Bailiwick and him safe Keepe soe that he have his
Body before his Maj.ties Justices att the next Court to Answer
unto John Hawkins of a plea of Trespasse upon the case

Att which Court viz the 23.th day of March Anno Dom 1696
the day of Returne of sd Writt came Cap.t Edward Sweatnam
high sheerif of said County and made Returne of sd Writt in
these Words viz Cepi p me Edw Sweatnam sheft

And the said John Hues ond the day aforesd in his proper person appears
and prayes thereof to Imparle until next Court which was granted
the same day is given to the Plt likewise which said Accon being
continued from Court to Court until this present day

And Now here att this day viz the 25.th day of August came as well
the said Plt John Hawkins as allsoe the Defend.t by William Hemsley
his Attorney &c.a

attached to Answer John Hawkins of a plea Tes
upon the case

And wherupon the said John Hawkins by Samuel Withers his Att.ry
complaineth that whereas the said John Hues the 25.th day of Feb.ry
Anno Dom 1694 att Chester River within the Jurisdicon of this Court
by his certain writing subscribed with his hand as his Act and deed
delivered and here into Court brought whose date is the same day
and Yeare aforesaid he did promise to pay to the said John Hawkins
by the order of One John Salter the sume of Two hundred and seaventy
six poundes Tobaccoe and in consideracon therof the sd John Hues
upon himselfe assumed and to the said John Hawkins faithfully
                                                                                    promised
