774 Att which Court viz the 23.th day of March Anno Dom 1696 the day of Returne of said Writt came Cap.t Edward Sweatnam high sheerif of sd County and made Returne of said Writt in these words Following viz Cepi p Edw Sweatnam sheft But the said Hugh Marsh Neither by himselfe nor Att.ry appearing Judgm.t that the sheerif be in Mercy And att a Court held for sd County the 22.th day of June Anno Dom 1697 came the said Hugh Marsh by Michael Earle his Att.ry as allsoe the sd Plts by W.m Hemsley their attorney and the sd W.m Hemsley in behalfe of the plts moves this Court that the said Defend.t may put in Especial Bayl to sd Accon which being considered by this Court Ordered that the sd Hugh M.rsh appeare by his Attorney Simon Wilmer Clk And now here this day viz the 25.th day of August Anno Dom 1697 came the sd plts by W.m Hemsley their Attorney as allsoe the Defend.t by Michael Earle his Attorney and said Accon standing for Tryal
And wherupon the sd Sarah Daniel and John by W.m Hemsley their Attorney complaineth that Whereas the sd Hugh Marsh on the 10.th day of October Anno Dom 1696 att Chester River w.thin the Jurisdicon of this Court stood Justly indebted unto them the said Sarah Daniel and John the full and Just sume of Tenn Thowsand poundes of Tobaccoe or the Value therof in Indian Corne & Wheat to Wit Wheat att Fifty poundes of Tobaccoe p Busshel & Indian Corne att Twenty poundes of Tobaccoe p Bushel it being the second Paym.t to be made by him the sd Hugh unto them the Sarah Daniel and John for a certain Water Mill with the app.rtnances therunto |
