771 On which day viz the sd 23.th day of March Anno Dom 1696 came the said John Hues in his proper person and Appeared to sd Accon and prayes therof to Imparle until next Court which was granted the same day is given to Plt likewise which said cause being continued from Court to Court unto this p.rsent day And now here att this day viz the 25.th day of August Anno Dom 1697 the said cause standing for Tryal came as well the said Plt Cap.t John Hawkins as allsoe the Defend.t John Hues by W.m Hemsley his Attorney &c.a
And whereupon the said John Hawkins by Samuel Withers his Attorney complaineth that whereas the said John hues the 26.th day of February Anno Dom 1694 att Chester River within the Jurisdicon of this Court by his certain Writing subscribed with his hand or his Act and deed delivered and here into Court brought whose date is the same day and Yeare aforesaid he did promise to pay or cause to be paid unto the said John Hawkins the sume of Fower hundred poundes of sound M.rchantable leaf Tobaccoe in Caske att some convenient place in Chester River after the Tenth day of October then next Ensueing Yett Neverthelesse the said John Hues the said sume of 400.ll of Tobaccoe unto the sd John Hawkins he hath not paid alltho often demanded but the same to pay he hath denied and refused to the damage of the sd John Hawkins Eight hundred poundes of the like Tobaccoe and therupon he brings this suit Withers p q.r pledges Jn.o Doe Ri Roe And the said John Hues by W.m Hemsley his Attorney pleads satisfaction and it appearing to this Court that the said Hues had paid the sume of Four hundred and Eight poundes of Tobaccoe for the use of the said Jn.o since the commencing of the Accon aforesaid Judgment is Awarded for a Non suit |
