770 belonging scituate upon Tersoms Creeke upon which said Place was a Nursery of about Three hundred Aple Trees and several quince Trees the One Moiety or halfe part of which Aple Trees and Twelve quince Trees he did not sell unto him the said Perigrine and that the said Phillip might quietly removed and beare away off from the sd bargained p.rmises one halfe part of the said Aple Trees & Twelve quince Trees the said Perigrine did by his certaine Noate from under the said Perigrine hand and here in Court brought oblieg himselfe to permit the said Phillip to remove the sd Trees Yett notwithstanding the sd Perigrine the One Moiety or halfe part of the said Aple Trees and Twelve quince Trees according to his writing aforsd would not permit or suffer him the sd Phillip to remove the same alltho often therunto required and the sd Phillip in fact saith that for want of the One Moiety or halfe part of the said aple Trees and the Twelve quince Trees he is damnified and damage hath to the value of Two Thowsand poundes of Tobaccoe and therupon he bringeth this suit Macklin p q.r pledges &c.a Jn.o Doe Ri Roe In which sd Accon there haveing been Two Writts Issued out consen.t to the same and according to time Expressed in the fore goeing Accon and the same Returned made by the sheerif as to the former Cap.t Thomas Coursey in behalfe of the said Perigrin Browne comes into Court and confesseth Judgm.t for 1000.ll of Tob Therfore it is considered by this Court that the Plt Phillip Holeager doe Recover from the Defend.t Perigrine Browne the said sume of One Thowsand poundes of Tobaccoe And the Plt as before promiseth to pay cost Simon Wilmer Clk Command was Given to the sheerif of Kent County the 28.th day of January Anno Dom 1696 to take John Hues if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto John Hawkins of a plea of Trespasse upon the case Att which Court viz the 23.th day of March Anno Dom 1696 the day of Returne of sd Writt came Capt Edward Sweatnam high sheerif of sd County and made Returne of said Writt in the sd day viz Cepi p me Edw Sweatnam sheft |
