And the said John Offley by Michael Earle his Attorney app.rs
but the Plt Cap.t James Smith by William Hemsley his Att.ry
moves this Court for Especial Baile which is Accordingly
Ordered
                                                        Simon Wilmer Clk

Thomas Weyatt and George Powell become Especial Bail
for the said John Offley and promise that the said John
Offley shall pay condemnacon If cost or they will doe it for him

Which said cause being continued from Court to Court until this
present day and Now here att this day viz the 25.th day of
August Anno Dom ^1697^ came as well the said Plt by William
Hemsley is Att.ry as allsoe the Defend.t by Michael Earle his Att.ry
and the said cause standing for Tryal the Plt declares viz

Kent fs  John Offley otherwayes called John Offley of sd County Plant.r
was summoned to Answer to James Smith of sd County Gent of
a plea that he render him the full and Just sume of Eight
Thowsand One hundred Eighty and One poundes of good sound
m.rchatable loase Tobaccoe in caske which to hum he Oweth and
from him he unjustly deteineth

And wherupon the said James by William Hemsley his Att.ry saith
that wheras the said John the 13.th day of Ap.ll Anno Dom 1696 in
sd County within the Jurisdicon of this Court by his certain bill or
writing obligatory sealed with his seal as his Act and deed delivered
and here in Court brought whose date is the same day and Yeare
did Acknowledge himselfe to stand bound and firmely indebted unto
the sd James in the full and Just sume of sixteen Thowsand Three hundred
^sixty^ and Two of the like quallified Tobaccoe in caske to be paid unto the sad Ja
Smith his Heires Ex.rs Adm.rs or Assignes Convenient in said County it being for
the well and truely paym.t of sd sume of 8181.ll of Tobaccoe by the Condicon of y.e
same bill to the well and truely paym.t therof he the sd Jn.o did bind himselfe his
Heires Ex.rs and Adm.rs firmly by the sd Bill Yett Neverthelesse the sd Jn.o the sd sume of
8181.ll of Tob according to the Ten.r of the sd Condicon to the sd obligacon annexed unto
the sd James he hath not paid alltho often demanded but the same to pay he hath
denied and refused to the damage of the sd James 10000.ll of Tobaccoe over & above
the sd sume of 8181.ll of Tobacco & therupon he brings this suit
