762 Att which Court viz the 23.th day of March Anno Dom 1696 the day of returne of the said Writt came Cap.t Edward Sweatnam high sheerif of said County and made Returne of sd Writt in these words Following viz Cepi p ^me^ Edw Sweatnam sheft And the said Defend.ts by Richard Macklin their Attorney appearing prayes therof to Imparle untill the Next Court w.ch was granted the same day was Given to the Plt likewise Which said cause being continued until the p.rsent day & now standing for Tryal as aforesd And now here att this day viz the 24.th day of August Anno Dom 1697 came the said Plt Thomas Bruff by Michael Earle his Attorney as allsoe the sd Defend.ts by Richard Macklin their Attorney the plt declares viz Kent fs William Sigley and Mercy his Wife Ex.rs of the last will and Testam.t of Edward Slade late of Chester River in Talbot County in Maryland and Deacd was summoned to Answer unto Thomas Bruff of the same Province aforesd of a plea that they render unto him the full sume of Foweteen hundred and sixty poundes of good sound every way well condiconed Tobaccoe which from them they unjustly deteine And Whereupon the said Tho by Michael Earle his Att.ry saith that Wheras the said Edward in his life viz on the 21.th day of of May Anno Dom 1687 in sd County within the Jurisdicon of this Court by his certain bill or Writing obligatory sealed w.th his seale as his Act and deed delivered and here in Court brought whose date is the same day and Yeare did bind himselfe his Heires Ex.rs and Adm.rs to pay or cause to be paid unto the said Thomas his Ex.rs Adm.rs and Assignes the said sume of 1460.ll of Tobaccoe quallified as aforesd convenient on Chester River att upon the tenth day of October then next ensueing the date of the same bill Yett Notwithstanding the sd Edward in his life time y.e sd sume of 1460.ll of Tobaccoe according to the Ten.r of the same Bill he did not pay nor the sd Mercy when sole and unmarried nor the said William and Mercy in their capacities since the death of him the said Edward the same they have not paid alltho often commanded but the same to pay they have denied and refused and still doe deny and refuse to the damage of the sd Thomas Two Thowsand Nine hundred poundes of Tobaccoe and therupon he brings this suit Earle p q.r pledges &c.a Jn.o Doe Ri Roe |
