759 of this Province Provided ^y.t^ You proceed not in any the cases aforesaid to take life or Member but that in Every such case You send the Prisoners with their Indictments and the whole matter depending before You to the next Provintial Court to be holden for this our Province whensoever or wheresoever to be holden there to be Tryed And farther Wee doe hereby Authorise and Impower You to Issue out Writts Processe and Attachments and to hold plea of oyer and Terminer in all Accons real personal and Mixt and after Judgm.t Execucon to Award in all causes Civil according to the Lawes orders and reasonable Customes made and provided in this our Province of Maryland Except matters relating to Titles of Land In which causes Civil soe to be Tryed (Excepting as before Excepted) Wee doe constitute and appoint You the several and respective psons as afd to be Judges as afd And therfore Wee doe Command You y.t You diligently Intend the Keeping of the Lawes and Orders of all and singuler other the p.rmises and att certain dayes appointed according to Act of Assembly in such case made and provided And att such place as You or any Four or more of You as afd shall in that behalfe Appoint You make Inquiry upon the p.rmises and performe and fulfill the same in forme aforesd doeing therin what to Justice appertaineth according to the Lawes Orders and reasonable Customes of this our Province And therfore Wee Command the sheerif of our County by virtue of these p.rsents that att the place and on the dayes afd that You or any such Four or more of You as afd shall make Knowne to him that he give his Attendance on You And if need require he cause to come before You or any such four or more of You such and soe many good & Lawfull men of Your County by whom the truth of the p.rmises may the better be Knowne and Inquired And lastly You shall cause to be brought before You on the day and att the place afd the Writts precepts processe and Indictm.ts to your Court and Jurisdicon belonging that the same may be Inspected and by due Course determined Wittnesse our Trusty and Well beloved Francis Nicholson Esq on Cap.t Gen.ll and Govenor in Cheif in and over our Province and Territory of Maryland this sixteenth day of June in the Ninth Yeare of our Reigne Annoq Dom 1697 signed Fr Nicholson sealed w.th broad seale |
