757 John Hodges being presented by Grand Jury in March last upon suspition for sterling Tobaccoe Command was therfore given to the sheerif of Kent County y.e 26.th day of March Anno Dom 1697 that he cause the said John Hodges if he should be found in his Bailiwick soe that he be and appeare before his Maj.ties Justices att the Next Court &c.a Att which Court viz the 22.th day of June Anno Dom 1697 came Cap.t Edward Sweatnam high sheerif of said County and made returne of sd Writt in these Words Following summoned Edw Sweatnam sheft And now here att this day viz the 23.th day of June Anno Dom 1697 came the said John Hodges in his proper person & being called appears to answer y.e Indictm.t Following
Jurisdicon of this Court the Fear of god before his Eyes not haveing on the 20.th day of Feb.ry Anno Dom 1696 did steale of the proper goods and Chattels of Tho Joce One hundred poundes of leafe Tobaccoe against the Peace of our soveraigne Lord the King &c.a and the Lawes in that case made and provided Macklin p Dom Rege To which Indictm.t the said John Hodges Pleaded not Guilty & for Tryal puts himselfe upon God and the Country Hemsley p Defen.t & y.e King likewise Macklin p D R Command was therfore Given to the sheerif that he cause 12 good and lawfull men &c.a To Try the Issue as above which Jury by Name are W.m Comegys John Weyatt Ralph Arundel John Hues John Davis Thomas Usher Thomas Hindsley W.m Sparkes Jun.r Thomas Scotton John Knots William Sigley W.m Robinson Jurors who being duely sworne to Try the Issue Joyned & haveing heard the whole matter and the Evidence being Roger Worrel Mary Peark and John Wade withdraw to consider on the p.rmises and after some time returne and declare that the said Jn.o Hodges is not guilty as he stands Indicted And the said John Hodges moves this Court that he may be cleared by Proclamacon which is accordingly performed Simon Wilmer Clk Benjamin Ricaud prefers to this Court a Peticon which is referred to the Justices therof by his Ex.lcy the Govern.t Touching a fine and Thomas Ricaud Declaring to this Court that the said Benjamin was sick att the time when the sd Fines were Imposed Ordered that the same be remitted consen.t to his Ex.lcy his Order Court adjourns to Court in Course Simon Wilmer Clk |
