750 The same Court sitts againe June y.e 23.th 1697 p.rsent as before Tryal Dockquett called Command was Given to the sheerif of Kent County the 28.th day of Jan.ry Anno Dom 1696 that he Take Daniel Norris if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to Answer unto W.m Elmes of a plea of Tres sur Ca Att which Court viz the 23.th day of March Anno Dom 1696 came Cap.t Edward Sweatnam high sheerif of sd County & made Returne of said Writt in these following Words viz Cepi Edw Sweatnam sheft And the said Daniel Norris on the said 23.th day of M.rch app.ring by William Hemsley his Attorney prayes therof to Imparte which was granted and the same day was Given to the Plt allsoe And now here att this day viz the 23.th day of June came the said Daniel Norris by William Hemsley his Attorney but the said Plt not prosecuting his Accon Judgm.t is Awarded for a Non suit Therfore it is considered by this Court that the Defend.t Daniel Norris doe recover from the Plt William Elmes as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of One hundred and Fifty poundes of Tobaccoe cost of suit Simon Wilmer Clk Command was Given to the sheerif of Kent County y.e 28.th day of January Anno Dom 1696 to take Thomas Joce if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the Next Court to be held for sd County to Answer unto W.m Bently of a plea of Trespass upon the Case |
