742 Command was given to the sherrif of Kent County y.e 28.th day of Jan.ry Anno Dom 1696 that he take John Lee of he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att y.e Next Court to Aanswer unto Michael Miller of a plea of Trespasse upon the case Att which Court viz the 23.th day of March then Next following came Cap.t Edward Sweatnam high sheerif of sd County and made returne of the sd Writt these Words following viz Non Est Inventus p Edw Sweatnam sheft And the sd Michael Miller by W.m Hemsley his Attorney representing to this Court that the said Jn.o Lee hath absented himselfe out of this Province and produceing his Acc.o proved before Coll John Hynson and Lietn.t Coll Hans Hanson the Ball.a of which Acc.o being Five hundred and Tenn poundes of Tobaccoe Therfore it is considered by this Court that the Plt Michael Miller have Attachm.t against the Estate of the sd John Lee for the sd sume of Five hundred and Tenn poundes of Tobaccoe as allsoe the sume of Two hundred Forty and One poundes of Tobaccoe cost of suit Simon Wilmer Clk Command was Given to the Coroner of Kent County y.e 28.th day of Jan.ry Anno Dom 1696 that he Attach any the goods Chattels &c.a of Robert Smith if they should be found in his Bailiwick to the value of Five Thowsand One hundred Forty and One poundes of Tobaccoe to satisfie unto W.m Edwin a certain debt and cost recovered &c.a the 4.th day of March Anno Dom 1695 and how &c.a that by Good and Lawfull men &c.a they be and appeare before his Maj.ties Justices att y.e next Court &c.a Att which Court viz y.e 23.th day of March y.e day of returne of sd Writt came Maj.r Thomas Coroner of said County and made returne of sd |
