Therfore it is considered by this Court that the plt Michael Miller doe recover from the Defend.t Robert Browne as well the said seaven hundred and Five poundes of Tobaccoe with One hundred and Twelve poundes of Tobaccoe Intrest for the same as allsoe the sume of Two hundred Forty and Three poundes of Tobaccoe cost of suit Simon Wilmer Clk Court adjournes till Too Morrow Eight of the Clock same Court sitts againe p.rsent as before M.rch y.e 25.th 1697
Command was Given to the sheerif of Kent County y.e 28.th day of Jan.ry Anno Dom 1696 that by good and lawfull men of his Bailiwick y.t he make Knowne unto John Chase if he should be therin found soe y.t he be and appeare before his Maj.ties Justices att the Next Court to shew cause &c.a why Execucon should not Issue ag.t him for Fourteen hundred Thirty and Eight poundes of Tobaccoe a certain Debt and cost Recovered ag.t him by Michael Miller att a Court held the 26.th day of June Anno Dom 1695 for sd County Att which Court viz the 23.th day of M.rch Anno Dom 1696 the day of returne of the sd Writt came Capt Edward Sweatnam high sheerif of sd County and made Returne of sd Writt in these words viz I have made Knowne to the within Named Jn.o Chase before Thomas Smith and Richard Triggs that he be and appeare before &c.a as by this p.rcept I am commanded Edw Sweatnam sheft And Now here att this day comes the sd John Chase with James Conway his security who promiseth that the sd Jn.o Chase shall pay to the sd Michael Miller the sd sume of Fourteen hundred thirty and Eight poundes of Tobaccoe with cost of suite he will doe it for him |
