Command was given to the sherif of Kent County the 28.th day January
Anno Dom 1696 to take Robert Browne if he should be found in his
Bailiwick and him safe Keepe soe that he have his Body before his
Maj.ties Justices att the Next Court to Answer unto Michael Miller of a plea
that he render him the full and Just sume of Two Thowsand Eighty and
Eight poundes of Every way good bright Tobaccoe and caske

Att which Court viz the 23.th day of March Anno Dom 1696 the day
of returne of said Writt came Capt Edward Sweatnam high sherrif of
sd County and made returne of the sd Writt in these Words viz Cepi p
Edw Sweatnam sheft

And now here att this day came as well the sd Plt by W.m Hemsley his
Attorney as allsoe the sd Defend.t by Michael Earle his Attorney and the
said cause standing for Tryal the sd Plt Declares in these following words

Kent fs     Robert Browne of Kent County Planter was summoned to
                Answer unto Michael Miller of the same County of a plea that
                he render him the full and Just sume of Two Thowsand Eighty &
                Eight poundes of every way good bright Tobaccoe in caske which
                to him he Oweth and from him he unjustly deteineth

And Wherupon the sd Michael Miller by W.m Hemsley his Attorney saith y.t
Wheras the sd Robert Browne on the 3.d day of September Anno Dom 1695
in the sd County within the Jurisdicon of this Court by his certain bill or Writing
obligatory sealed with his seale as his Act and deed delivered and here in
Court brought whose date is the same day and Yeare did bind himselfe his
Heires Execut.rs and Adm.rs to pay or cause to be paid unto the sd Michael his Heires
Ex.rs or Adm.rs the sd sume of 2088 poundes of Tobaccoe quallified as aforsd Yett
Notwithstanding the sd Robert the sd sume of 2088 poundes according to the
Ten.r of the same bill unto the sd Michael he hath not paid alltho often demanded
but the same to pay he hath denied and refused to the damage of the
sd Michael the sume of Four Thowsand poundes of Tobaccoe and therupon
brings this suit
                                        Hemsley p q.r pledg &c.a Jn.o Doe Rich Roe

And the sd Robert Browne by Michael Earle his Attorney makeing it appeare
to this Court as well by the Oath of W.m Price as by the sd Michael Millers
owne Acc.o that ther is paid the sume of 1383.ll of Tobaccoe Judgm.t is Awarded
for the sd Ballance being seaven hundred and Five poundes of Tobaccoe
with Intrest and cost of suit
