Command was given to the sheerif of Kent County y.e 28.th day of Jan.ry
Anno Dom 1696 to take Josias Clifton if he should be found in his Bailiwick
and him safe Keepe soe that he have his Body before his Maj.ties
Justices att the Next Court to Answer unto Peter Alaby of a plea of Tres
upon the case

Att which Court viz the 23.th day of March the day of the Returne of
sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made
returne of sd Writt in these following Wordes viz Cepi p Edw Sweatnam
                                                                                            sheft

And now here att this day the sd cause standing for Tryal came the sd
Peter Allaby by W.m Hemsley his Attorney and declareth viz

Kent fs     Josias Clifton of Kent County Mariner stands Attached to Answer unto
                Peter Allaby of a plea of tres upon the case

And Wherupon the sd Peter Allaby by W.m Hemsley his Attorney complains
that Wheras the sd Josias on the First day of December Anno Dom 1696 in the
County within the Jurisdicon of this Court stood Justly indebted unto the sd Peter
in the full and Just sume of Eight hundred Forty seaven and a halfe poundes
of good sound M.rchtable Tobaccoe in caske by accompt the perticulers therof
are here in Court brought in consideracon therof the sd Josias Clifton upon himselfe
assumed and to the sd Peter he faithfully promised that he the sd Josias the sd
sume of 847 1/2.ll of Tobaccoe unto the sd Peter would well and truely pay when
therunto required Yett Nevertheless the sd Josias the sd sume of 847 1/2.ll of Tobaccoe
according unto his promise and Assumption aforesd unto the sd Peter Allaby
he hath not paid alltho often required but the same to pay he hath denied &
refused to the damage of the sd Peter sixteene hundred poundes of Tobaccoe
and therupon he brings this suit

To which the sd Josias Clifton Neither by himselfe nor by his Attorney makeing
any reasonable defence Judgm.t is Awarded for sd sume and cost

Therfore it is considered by this Court that the plt Peter Allaby doe recover
from the Defend.t Josias Clifton as well the aforsd sume of Eight hundred Forty
seaven and a halfe poundes of Tobaccoe as allsoe the sume of Two hundred sixty
and three poundes of Tobaccoe cost of suit
