Yeare did bind himselfe his Heires Ex.rs or Ad.rs to pay or cause to be
paid unto the sd Nich.o Milbourne his Heires or Assignes
the sd sume of 546.ll of Tobaccoe quallified as aforesd on demand
after the date of the same Bill Yett Notwithstanding the sd Nich.o
Cloudes the said sume of 546.ll of Tobaccoe according to the Ten.r
of the same Bill unto the sd Nich.o Milbourne he hath not paid
alltho often demanded but the sd to pay he hath denied & refused
to damage of y.e sd Nich.o Milbourne the sume of 1000.ll Tob
and therupon he brings this suit

the sd sume of Five hundred Forty and six poundes of Tobaccoe
as allsoe the sume of Two hundred Fifty and Five poundes of

Command was given to the sheerif of Kent County y.e 30.th day of
October Anno Dom 1696 that he take John Oliver if he should be
found in his Bailiwick and him safe Keepe soe that he have his Body
before his Maj.ties Justices att y.e next Court to Answer unto Henry Land
of a plea of Trespasse upon the case &c.a

Att which Court viz the 24.th day of November Anno Dom 1696 y.e
day of the returne of the sd Writt came Capt Edward Sweatnam high
sheerif of sd County and made returne of sd Writt in these following
words viz Cepi Corpus p Edw Sweatnam sheft

Which sd cause being continued from Court to Court until this p.rsent
day and Now standing for Tryal came the sd Henry Land by W.m Hemsley
his Att.ry and declareth in Manner and forme Following
