in Chester River upon demanded to the which paym.t well &
truely to be made and don he the sd Henry did oblieg himselfe
his Heires Ex.rs and Adm.rs by the sd Bill Yett Notwithstanding y.e
sd Henry the sd sume of 520.ll of Tobaccoe according to the Ten.r of
the same bill unto the sd Richard in his life time he did not pay
nor the same to the sd John in his Capacity to whome Adm.rn in due
forme of Law was committed to the said Henry he hath not paid
alltho often demanded but the same to the sd Jn.o to pay he hath
denied and refused to the Retardacon and damage of the use
sd Intestate Estate One Thowsand poundes of Tobaccoe and
therupon he brings this suit

The Defend.t being served with a Coppy of the Declaracon
according to Act of Assembly in that case made and provided
but not appearing to Defend the same Judgm.t is awarded by
Nihil Dicitt for sd sume of 520.ll of Tobaccoe and cost

Therfore it is considered by this Court that the Plt John
Lamb in his capacity as aforesaid doe recover from the
Defend.t ^Henry Green^ as well the sd sume of Five hundred and Twenty pounds
of Tobaccoe as allsoe the sume of Two hundred Fifty and Nine
poundes of Tobaccoe cost of suit

Ordered by this Court that the Two Thowsand poundes of Tobaccoe
assessed in the County Leavy for paying for the 3.a of Land
appointed p Act of Assembly wheron to build a Court house
and appraised by verdict of a Jury att the aforesd sume of 2000.ll
of Tobaccoe be by the sheerif paid to Edward Fry

Benjamin Ricaud p.rfers a Peticon (being by his Exl.cy the Gov.rs
referred to this Court) touching a fine imposed upon the said
Benjamin by this Court for not appearing being sum as a Jury
man but the said Benjamin makeing no reasonable Excuse why
he did not appeare being summoned as aforesd and not talking
with that reverence as he ought to doe to his Maj.ties Justices but
on the contrary useing Threatning Expressions this Court have thought
fitt not to remit the said fine
