Aforesd sume of 724 poundes Tobaccoe in the Writing aforesaid
mentioned unto the sd Jn.o when therunto the sd Richard
should be required he would well and truely ay Yett Neverthelesse
the sd Richard alltho he hath paid Four hundred pounds
Tobaccoe part of the sd 724.ll Tobaccoe Yett as to the residue
being Three hundred Twenty four poundes Tobaccoe his
promise and Assumption aforesaid little regarding but
plotting and contriveing him the said Jn.o craftily and subtilly
to defraud and deceive the sd sume of 324 poundes Tobacco
unto the aforesd Jn.o Hawkins according to his promise and assumption
thereon as aforesd he hath not paid alltho to doe the same
the 2.d day of December Anno Dom 1696 att divers times
before and after att Chester River in Kent County within the
Jurisdicon of this Court he was therunto by the sd Jn.o required
but the same to pay the sd Richard doth deny to the damage
of the sd Jn.o six hundred poundes of Tobb and therupon he brings
this suit

And the said Richard Iagoe being served with a Coppy of the
above declar according to Act of Assembly in that case made &
provided But not appearing to the same Judgm.t is by this Court
Awarded for the said sume of 324.ll of Tobaccoe and cost of suit

Therfore it is considered by this Court that the plt John Hawkins
doe Recover from the Defend.t Richard Iagoe as well the said sume
of Three hundred Twenty and Four poundes of Tobaccoe as allsoe
the sume of Two hundred Ninety and Nine poundes of Tobaccoe
cost of suit
