713 And the sd Thomas Ford in his proper person comes and appears to the said Accon and being served with a Coppy of the declr according to Act of Assembly in such case made and provided But makeing no reasonable objection against the same Judgm.t is awarded for said sume of Three hundred and Two poundes of Tobaccoe and cost Therfore it is considered by this Court that the plt John Hawkins doe Recover as well the said sume of Three hundred and Two poundes of Tobaccoe as allsoe the sume of Two hundred Ninety and Nine poundes of Tobaccoe cost of suit Simon Wilmer Clk Command was given to the sheerif of Kent County the 26.th day of November Anno Dom 1696 to take Richard Iagoe if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to be held for sd County to Answer unto John Hawkins of a plea of Trespasse upon the case Att which Court viz this present day the day of the returne of the Writt aforesaid came Capt Edward Sweatnam high sheerif of said County and made returne of said Writt in these words viz Cepi p Edw Sweatnam sheff
And the sd Jn.o by Samuel Withers his Attorney complaineth that whereas the sd Richard the 22.d day of Feb.ry Anno Dom 1694 att Chester River within the Jurisdicon of this Court by his certain Writing subscribed with his hand as his Act and deed delivered and here in Court brought whose date is the same day and Yeare aforesd he did promise to pay to the sd Jn.o Hawkins by order of One Jn.o Salter the sume of seaven hundred Twenty and four poundes of Tobaccoe & in consideracon therof the sd Richard upon himselfe Assumed & to the sd Jn.o faithfully promised that he the sd Richard the aforesd |
