Command was given to the sheerif of Kent County the 26.th
day of November Anno Dom 1696 to take Thomas Ford
if he should be found in his Bailiwick and him safe Keepe
soe that he have his Body before his Maj.ties Justices att the
Next Court to be held for sd County to Answer unto John
Hawkins of a plea of a plea of Trespasse upon the case

Att which Court viz this present day the day of the returne
of the Writt aforsd came Capt Edward Sweatnam high sheff
of sd County and made returne of the said Writt in the sd
words following viz Cepi

was Attached to Answer John Hawkins
of a plea of Trespasse upon the case

And whereupon the said Jn.o by Samuel Withers his Att.ry complaineth
that whereas the said Thomas the 22.d day of February Anno Dom 1694 att
Chester River within the Jurisdicon of this Court by his certain Writing
subscribed with his hand as his Act and deed delivered and here in Court
brought whose date is the same day and Yeare aforsd he did promise
to pay to the said John by the order of one Jn.o Salter the sume of seaven
hundred poundes of Tobaccoe in consideracon therof the sd Thomas upon
himselfe Assumed & to the sd Tho should be required he would well and
truely pay Yett Neverthelesse the sd Tho alltho he hath paid Three hundred
Ninety Eight poundes of Tobaccoe Yett as to the residue being 302 pounds
Tobaccoe his promise and Assumption little regarding but plotting and
contriveing him the sd Jn.o craftily and subtilly to defraud and deceive
the sd sume of 302 poundes Tob unto the aforesd Jn.o according to his
promise and Assumption theron as aforsd he hath not paid alltho to doe
the same the first day of December Anno Dom 1696 att divers times
before and after att Chester River in Kent County within the Jurisdicon
of this Court he was therunto by the sd Jn.o required but the same to pay
the sd Tho doth deny to the damage of the sd Jn.o six hundred poundes
of Tobaccoe and therupon he brings this suit
