Plea the sd  Defend.t by W.m Hemsley his Attorney comes and
defends the force and Injury when &c.a and saith that the said
William Sparkes his Accon aforesd ag.t him the said Defend.t he
ought not to have and maintaine because he saith he did not
assume in Manner and forme as he the sd Plantif in his declr
hath sett forth and of this he puts himselfe upon the Country
                                                                            Hemsley
And the plt in like Manner Jones

Command is therfore given to the sheerif to cause Twelve good
and Lawfull men of his Bailiwick to come before this Court to
Try the Issue Joyned Betweene the said Plt and Defend.t which
Jury by Name are viz

Robert Norrest
Thomas Ford
Stephen Whetston
Samuel Wallis
 Robert Bishop
John Chaires
Thomas Hix
Jn.o Meridith
 John Knots
Thomas Beckles
Michael Miller Jn.r
James Weyett
Jurors

Which Jury being duely sworne to Try the Issue Joyned as above
and haveing heard the declar and plea as allsoe the pleadings
as well on behalfe of the plt or the Defend.t withdraw to consid.r
on the premises and after some time doe returne to the Barr
who being duely called as allsoe the plt and defend.t who app.r
by their Attornies and the Clerke demanding of the Jury wether
they be Agreed and likewise who they find for by their forman
they Answer that they find for the Defend.t and soe they say all
Judgm.t According to the verdict of the Jury

Therfore it is considered by this Court that the Defend.t
Walter Lodge doe Recover from the Defend.t William Sparkes
Jun.r as well the sume of Fifty poundes of Tobaccoe for a Non
suit as allsoe the sume of Fower hundred and seaventy poundes
of Tobaccoe cost of suit
