Command was given to the sheerif of Kent County y.e 26.th
day of November Anno Dom 1696 to take Walter Lodge if
should be found in his Bailiwick and him safe Keepe soe
that he have his Body before his Maj.ties Justices att the next
Court to be held for said County to Answer unto William Sparkes
Jun.r of a plea of Trespasse upon the case

Att which Court viz this present day the day of the returne
of the sd Writt came Capt Edward Sweatnam high sheerif of
sd County and made returne of the said Writt in these words viz

William Sparkes Jn.r of a plea of Trespasse upon the case

Wherupon the said William Sparkes by Griffith Jones his Att.ry
complains that wheras the said Walter Lodge on the 10.th day of
May Anno Dom 1696 in the sd County within the Jurisdicon of
this Court stood Justly indebted unto the sd William the full and
Just sume of Two Thowsand poundes of Tobaccoe for One horse
which was att the Especial instance and request of him the said
Walter sould and delivered In consideracon therof he Assumed upon
himselfe and to him the said William did then and there faithfully
promise that he the said Walter the aforesd sume of Two Thowsand
poundes of Tobaccoe to him the said William when he should be
therunto afterwards required would and faithfully pay & content
and alltho he the said Walter pd and sattisfied to him the
said William Twelve hundred pds of Tobaccoe of the aforesd Two
Thowsand poundes of Tob Yett the aforesd Walter his promise &
assumption aforesd as to the Eight hundred poundes of Tobaccoe
residue little regarding but plotting and fraudulently intending
him the sd W.m of the aforsd 800.ll of Tob craftily to deceive & defraud
the ^same^ 800.ll Tobaccoe to him the said William afterwards he hath been
therunto required according to his promise and Assumption aforsd he
hath not paid or in any manner for the same satisfied but the
same wether to pay he hath alltogether refused and denied and
as Yett refuse to the damage of him the said William 1600.ll
Tobaccoe And therupon he brings this suit
