706 Unto the said Jonas he hath not paid all the often demanded but the same to pay he hath denied and refused to the damage of the said Jonas seaven hundred poundes of tobaccoe and therupon he brings this suit Hemsley p q.r pledg &c.a Jn.o Doe Ri Roe And the sd William North by Samuel Withers his Att.rs comes and defends the force and Injury when &c.a and for plea saith he the sd William North is not guilty in Manner and forme and puts himselfe upon the Country Withers And the Plt in like manner Hemsley Command is therfore given to the sheerif to cause Twelve good and Lawfull men of his Bailiwick to come before this Court to try the Issue Joyned Betweene the said Plt and Defend.t which Jury being called to the Barr are by Name these that Follow viz
Which Jury being duely sworne to Try the Issue Joyned as above and haveing the Declar and Plea before recited definitly read and likewise hearing the pleadings on both sides to the same the Court giveth them their charge who withdraw to consider on the p.rmises and in some smale [illegible] doe returne who being againe called according to the above Pannel as allsoe the Plantif and defend.t who both both by their said Attornies appeare and being asked by the clerk whether they be Agreed of their ^verdict^ by their forman they answer that they are Agreed and doe find for the plantif And the Judgm.t is Awarded according to the Verdict of the Jury Therfore it is considered by this Court that the Plt Jonas Greenwood doe Recover from the Defend.t William North as well the aforsaid sume of Three hundred Eighty and Fower poundes of Tobaccoe as allsoe the sume of five hundred fifty and Five poundes of Tob cost of suit Simon Wilmer Clk |
