of this Court In consideration and att the Especial instance and require
of him the said Richard that if the said William Doorty would sell and
deliver unto the said Richard a certain stock of cattle viz three Cowes
one Heifer of Two Yeares old One steere of Two Yeares Old and One Yearling
Calfe that then he the said Richard upon himselfe Assumed and
to the said William Doorty faithfully promised that he the said Richard
would pay and satisfie unto the said William Doorty what the said Cattle
should reasonably be worth when therunto required And the said W.m
Doorty in fact saith that he trusting to the promise and assumption aforesaid
of him the said Richard att the day and att the place aforesd he
did sell and deliver unto the said Richard the sd stock of cattle viz
Three Cowes One Heifer One steere and one Yearling as aforesd And
the said William Doorty farther in fact saith that he reasonably deserves
for the Three Cowes the sume of Two Thowsand ^seaven hundred^ poundes of Tobaccoe &
for the Two Yeare old Heifer four hundred poundes of Tobaccoe and
for the said Two Yeares old steere four hundred poundes of Tobaccoe and
for the sd Yearling Calfe the sume of Two hundred poundes of Tobaccoe
all which amounts to the sume of ^three thowsand^ seaven hundred poundes of Tobaccoe
Yett notwithstanding the sd Richard his promise and assumption aforesaid
in no wise regarding but plotting and contriveing and fraudulently
intending him the sd W.m Doorty craftily deceiptfully and subtilly in
this behalfe to deceive and defraud the said sume of 3700.ll of Tobaccoe
unto the said William Doorty he hath not paid alltho often required
but the same to pay he hath denied and refused to the damage of
the said William Doorty and therupon he brings this suit

And Richard Burke by Griffith Jones his Attorney comes and
Defendeth the force and Injury when &c.a and for plea saith that he
assumed it not as the plt hath sett forth in his Declar and proves that
it may be Enquired by the Country

And the plt in like manner Hemsley

Command is therfore given to the sheerif that he cause Twelve
good and Lawfull men of his Bailiwick to come before this
Court to try the Issue Joyned Between the said plt and Defend.t
the Jury being called to the Bar and these that Follow according
to the Pannel therof taken by the sheerif viz Robert Norrest
Thomas Ford Stephen Whetston Samuel Wallis Rob.t Bishop Michael
Miller Jun.r Tho Hix Jn.o Meridith Jn.o Knots Tho Beckles Tho Godwin Jas Weyatt
