700 the Wife of the said Edward Smith and his Woman Serv.t Henry Green and his Wife Thomas Baily and Sarah Johnson be immediatly caused by the sheerif to Come before this Court venire accordingly Issued Richard Fillingham haveing Peticoned this Court that he might have the remaining part of his Estate now in the handes of M.r Thomas Joce and the said Joce being by order of this Court sum to make objections ag.t the same if any he had but now not appearing and the said Fillingham producing to this Court a Accompt by way of D.r and C.r of the sd Estate by which it appeared that there was due to Ball.a to the said Fillingham the sume of 2292.ll of Tobaccoe Threfore it is considered by this Court that the said Rich Fillingham doe Recover from the sd Thomas Joce as well the aforesaid sume of Two Thowsand Two hundred Ninety and Two poundes of Tobaccoe as allsoe the sume of Eight hundred Eighty and Fower poundes of Tobaccoe cost Expended Simon Wilmer Clk Command was given to the sheerif of Kent County the 26.th day of November Anno Dom 1696 to take Richard Burke and him safe keepe soe that he have his Body befor his Maj.ties Justices att the Next Court to be held for said County to Answer unto W.m Doorty of a plea of Trespasse upon the case Att which Court viz the 26.th day of Jan.ry the day of returne of the Writt aforesaid came Capt Edward Sweatnam high sheeff of said County and made returne of the said Writt in those words viz Cepi Corpus p Edw Sweatnam sheff
