702 Which Jury being duely sworne to try the Issue Joyned as above and haveing heard the Declaracon and plea as before recited David Davis and Mary his Wife being sworne as Evidences and sume by the Defend.t the Court and Jury haveing heard the pleadings on both sides the Court give the Jury their charge who withdraw som time to consider on the p.rmises doe returne with this following verdict Wee of the Jury doe find for the Defend.t and therupon this Court gives Judgment Therfore it is considered by this Court that the Defend.t Richard Burke doe Recover from the Plt William Doorty as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of Simon Wilmer Clk Command was given to the sheerif of Kent County the 26.th day of November Anno Dom 1696 to take John Bowles if he should be found in his Bailiwick and him safe Keepe soe y.t he have his Body before his Maj.ties Justices att the Next Court to be held for said County to Answer unto Thomas Theakston of a plea that he render him the full and just sume of Twelve hundred poundes of Tob &c.a Att which Court viz the 26.th day of Jan.ry the day of returne of the Writt aforesaid came Capt Edward Sweatnam high sheerif of said County and made returne of the said writt in these words following viz Cepi Corpus Edw Sweatnam sheft
he render him the full and just sume of Twelve hudnred poundes of good sound M.rch.table leaf Tobaccoe in caske which to him he Oweth and from him he unjustly deteineth And the said Thomas Theakston by W.m Hemsley his Att.ry saith that whereas the said John Bowles on the 26.th day of Jan.ry Anno Dom 1691 in said County within the Jurisdicon of |
