699 And the said Capt Edward Sweatnam in his proper persons comes and prayes liberty therof to Imparle until next Court which is granted the same day is given to the plt likewise And now att this day came as well the said Simon by William Hemsley his Attorney as allsoe the said Capt Edward Sweatnam in his proper person And it appearing to this Court that there is in the hands of the said Capt Edward Sweatnam the said sume of 1600.ll Tob condemned to the use of the said Joshua Hollingshead att a Court held for said County the 3.d day of March Anno Dom 1695 as p y.e Record of the said Court doth appeare Judgmt is awarded for the same Therfore it is considered by this Court that the Plt Simon Wilmer in his Capacity as aforesaid have Execucon for the sd sume of sixteen hundred poundes of Tobaccoe against the said Capt Edward Sweatnam Simon Wilmer Clk
Therfore it is considered by this Court that the Plantif Benj Blackleach doe Recover from the Defend.t John Sutton as well the sume of seaven thowsand poundes of Tobaccoe as allsoe the sume of Two hundred Thirty and One poundes of Tobaccoe cost of suit Simon Wilmer Clk The sheerif being by this Court Ordered that he cause Edward Smith Immediatly to Appeare before this Court upon an Informacon Exhibited to this Court by M.r William Hemsley Clerk of the Indictments the said Edward Smith now appeares and being by this Court Examined concerneing some Words by him spoke relateing to the Scotch being in Armes and the Death of King William informed this Court that what he the said Edward had spoke he heard it from his Wife who lately had been at Henry Greens and heard his Wife relate what had been soe divulged it is therfore Ordered by this Court that |
