697 Att which Court viz on the 24.th day of November Anno Dom 1696 the day of returne of the writt aforesaid came Capt Edward Sweatnam high sheerif of said County and made returne of the said Writt in these Words viz Cepi Corpus Edw Sweatnam sheft
to Thomas Steevens of a plea of Trespasse upon the case And wherupon the said Thomas by William Hemsley his Att.ry complaines that whereas the said William in his life time viz on the 10.th day of March Anno Dom 1693 in said County within the Jurisdicon of this Court stood justly indebted unto the said Thomas the full and just sume of seaven hundred and Thirty poundes of Tob In consideracon therof the said W.m in his life time upon himselfe assumed and to the said Thomas faithfully promised that he the said Thomas ^he^ would well and truely pay when therunto required Yett Neverthelesse the said W.m In his life time the said sume of 730.ll of Tobaccoe according to his promise and assumption aforesd unto the sd Thomas he did not pay nor the said Sarah when sole said Stephen and Sarah in ther capacities since their intermarriage and since the death of the said William nor any of the same to pay he hath denied and refused to the damage of the said Thomas Twelve hundred poundes of Tobaccoe & therupon he brings this suit Hemsley p q.r pledg &c.a Jn.o Doe Ri Roe And the said Stephen Whetston in his proper person comes and prays liberty therof to Imparle until nex Court which is granted & to y.e Plt &c.a And now att this day came the said Thomas by W.m Hemsley his Att.r and the said Stephen in his proper person but makeing no reasonable objection to the same Judgment is Awarded for the sume of six hundred and sixty poundes of Tobaccoe and cost of suit |
