696 The said John Lee the said sume of 821.ll of Tobaccoe unto the said William Frisby would well and truely pay when therunto required Yett Neverthelesse the said John Lee the said sume of 821.ll of Tobaccoe according to his promise & assumption aforesd unto the said William Frisby he hath often refused and denied to the damage of the said W.m Frisby sixteen hundred poundes of Tobaccoe and therupon he brings this suit Hemsley p q.r pledg &c.a Jn.o Doe Ri Roe And the said John Lee in his proper person comes and prayeth libertie therof to Imparle until Next Court which is granted y.e same day is given to the Plt likewise And Now att this day came as Well the said William Frisby by W.m Hemsley his Attorney as allsoe the said John Lee by Griffith Jones his Attorney and the matter standing for Tryal the said Griffith Jones pleads non sum informatus Therfore it is considered by this Court that the Plt William Frisby doe recover from the Defend.t John Lee as well the aforesaid sume of Eight hundred Twenty and One poundes of Tobaccoe as allsoe the sume of Two hundred sixty and Three poundes of Tobaccoe cost of suit Simon Wilmer Clk Command was given to the sheerif of Kent County the 30.th day of October Anno Dom 1696 to take Stephen Whetstone and Sarah his Wife Ex.rs of William Deane &c.a if they should be found in his Bailiwick and them safe Kepe soe that he have their Bodies before our Justices att the next Court to be held for said County to Answer unto Thomas Steevens of a plea of Trespasse upon the case |
