And whereupon the said Phillemon by William Hemsley his Attorney
saith that whereas the said William Edwin the 6.th day of August
Anno Dom 1689 in sd County within the Jurisdicon of this Court
by his certain bill or writing obligatory sealed with his seal as his
Act and deed delivered and here into Court brought whose date
is the same day and Yeare did bind himselfe his Heires Execut.rs &
Adm.rs to pay or cause to be paid unto the said Phillemon his Heires
Ex.rs Adm.rs or Assignes the said sume of 1645.ll of Tobaccoe convenient
in said County upon demand Yett Notwithstanding the said William
the said sume of 1645.ll of Tobaccoe according to the Ten.r of the
same bill unto the said Phillemon he hath not paid alltho he the sd
William Edwin hath therunto been often demanded but the same
to pay he hath denied and refused to the damage of the said Phillemon
on Three Thowsand poundes of Tobaccoe and therupon he brings
this suit
                        Hemsley p q.r pledg &c.a Jn.o Doe Ri Roe

And the said William Edwin in his proper person comes and
prayes discompt of 804.ll of Tob by him paid in part of the above
menconed bill which being by this Court and Plt allowed of Judgm.t
is Awarded for the Ball.a being 841.ll of Tobaccoe

Therfore it is considered by this Court that the Plt Phillemon
Hemsley doe recover from the Defend.t William Edwin as well the
said sume of Eight hundred forty and One poundes of Tobaccoe
as allsoe the sume of Two hundred Forty and seaven poundes of
Tobaccoe cost of suit
