Command was given to the sheerif of Kent County the
30.th day of October Anno Dom 1696 to take John Hues
if he should be found in his Bailiwick and him safe Keepe
soe that he have his Body before his Maj.ties Justices att the
next Court to be held for said County to Answer unto Henry
Cotton of a plea that he render unto him 400.ll of Tob &c.a

Att which Court viz on the 24.th day of November Anno
Dom 1696 the day of the returne of said Writt came Capt
Edward Sweatnam high sheerif of said County and made
returne of said Writt in these following Words viz Cepi
p Edw Sweatnam sheeff

And the said John Hues in his proper person appeares and
Imparles until next Court y.e same day &c.a

Kent fs     John Hues otherwise called John Hues late of Talbot
                County Plt.r was summoned to Answer unto Henry
                Costin of Talbot County of a plea that he render unto him
                the full and just sume of Fower hundred poundes of
                good sound M.rchantable Tobaccoe in Caske which to him
                he Oweth and from him he unjustly deteineth

And wherupon the said Henry by W.m Hemsley his Attorney
saith that whereas the said John Hues on the 20.th day of July
Anno Dom 1693 in the sd County within the Jurisdicon of this
Court by his certain bill or Writing obligatory sealed with his
seale as his Act and deed delivered and here in Court brought
whose date is the same day and Yeare did bind himselfe his Heires
Ex.rs Adm.rs or Assignes to pay or cause to be paid unto the said
Henry Costin his Heires Execut.rs Adm.rs or Assignes the said sume
of 400.ll Tobaccoe quallified as aforesaid convenient in Chester
River att or upon the 10.th day of October then Next Ensueing y.e
date of the same bill Yett Notwithstanding the said John Hues the
said sume of 400.ll of Tobaccoe according to the Ten.r of the same
bill unto the said Henry Costin he hath not paid alltho of condemanded
but the same to pay he hath denied and refused and still doth
to the damage of the said Henry 800.ll of Tob & therupon he brings this
suit
