Therfore it is considered by this Court that the plantif
John Salter doe Recover the said sume of Five hundred
Forty and six poundes of Tobaccoe as allsoe cost expended
in the said suit

Kent fs  Peter Peterson otherwise called Peterson of Kent
County Carpender was summoned to Answer to Tho Lester
of a plea that he render him the full and just sume of
six hundred poundes of good sound Merchantable Leafe
Tobaccoe in casque which to him he Oweth and from him
he Unjustly deteineth And whereupon the sd Tho Leister by
W.m Hemsley his Attorny saith that Whereas the said Peter
on the first day of August Anno Dom 1696 in sd County with
in the Jurisdicon of this Court by his certain Bill or Writing
obligatory sealed with his seale as his Act and deed delivered
and here in Court brought whose date is the same day &
Yeare did bind himselfe his Heires Ex.rs and Adm.rs to pay or
cause to be paid unto the sd Thomas his Heires Ex.rs Adm.rs or
Assignes the sd sume of 600.ll Tobaccoe quallilfied as aforesd
in some convenient place in sd County att or upon the
Tenth day of October then Next Ensueing the date of the
the same Bill Yett notwithstanding the sd Peter the sd sume
of 600.ll Tob according to the Ten.r of the same Bill unto the
sd Thomas he hath not paid but the same he hath denied
and refused to the Damage of the sd Thomas the sume of
Twelve hundred poundes of Tobaccoe and therupon he
brings this suit

The sheerif haveing Returned the Writt Capi Corpus and there
being a Coppy of the above Declar sent therewith but
the Defend.t not appeareing therto Judgm.t is awarded for sd
