Therfore it is considered by this Court that the Plt
Thomas Leister doe Recover from the Defend.t as well the
sume of six hundred poundes of Tobaccoe as allsoe
cost Expended in this suit

Trespass sur Case Declr viz

Kent fs Robert Peark of Kent County planter stands
attached to Answer unto Robert Hilton of a plea of Trespasse
upon the case And Whereupon the sd Robert Hilton by
William Hemsley his Attorney complains that Whereas the
sd Robert Pearke on the 10.th day of December Anno Dom
1695 in the sd County within the Jurisdicon of this Court
stood justly indebted unto the sd Robert Hilton in the full
and just sume of six hundred Fifty and Two poundes
of good sound M.rchantable Tobaccoe in casque by Acco.t the
perticulers therof are here into Court brought in consideration
therof the sd Robert Peark upon himselfe assumed &
to the said Robert Hilton he faithfully promised that
he the sd Rober Peark the sd sume of 652.ll of Tobaccoe unto
the sd Robert Hilton would well and truely pay when therunto
required Yett Neverthelesse the sd Robert Peark the
sd sume of 652.ll Tobaccoe according to his promise and
assumption aforesd unto the sd Robert Hilton he hath not
said alltho often required but the same to pay he hath denied
and refused to the damage of the sd Robert Hilton
1200.ll Tobaccoe and therupon he brings this suit

And the Defend.t p Griffith Jones his Attorny prayed discompt
of Three hundred poundes of Tobaccoe due to him from the sd
Robert Hilton as p Acc.o here in Court proved doth appeare
