Did bind himselfe his Heires Execut.rs Adm.rs or Assignes to pay
or cause to be paid unto the sd Phillemon his Heires Exec.rs Adm.rs
the sd sume of 1620.ll of Tobaccoe quallified as aforesd conveniently
in sd County att or upon the Tenth day of October then
next Ensueing the date of the same Bill Yett Notwithstanding
the sd William in his life time the said sume of 1620.ll of Tob
quallified according to the Ten.r of the same bill unto the sd
Phillemon they did not pay nor the said Sarah when sole
and nor the sd Stephen and Sarah since their intermarriage
nor either of them in any of their capacities since the shed
death of the sd W.m they have not paid alltho often demanded
but the same to pay they have denies and refused to the
damage of the sd Philemon the sume of Three Thowsand
poundes of Tobaccoe and therupon he bring this suit

To which the sd Stephen Whetstone appearing but makeing
no reasonable defence Judgm.t is awarded for the said sume
of 1600.ll poundes of Tobaccoe

Therfore it is considered by this Court that the Plt Philemon
Hemsley doe Recover from the Defend.ts Stephen Whetstone
and Sarah his as Execut.rs of William Deane and out of the
Estate of the sd William Deane the sd sume of sixteene hundred
poundes of Tobaccoe as allsoe cost of suit
