the Plantif by W.m Hemsley his Attorney moves for Attachm.t which is accordingly granted Therfore it is considered by this Court that the Plt John John Chaires have Attachm.t for the aforesd sume of sixteene hundred Fifty and Eight poundes of Tobaccoe and halfe a pound pound of Tobaccoe with cost of suit being according to bill of cost filed Four hundred Eighty & seaven poundes of Tob Simon Wilmer Clk
Kent fs Stephen Whetstone and Sarah his Wife Ex.rs of the last Will and Testam.t of William Dean late of sd County deceed summoned to Answer to Philemon Hemsley of a ploy that they render him the full and just sume of sixteen hundred poundes of good sound and every way well condiconed Tobaccoe in caske w.ch from him they unjustly detaine Whereupon the sd Phillemon by William Hemsley his Attor.ny saith that wheras the sd William Deane in his life time viz on the sixth day of August Anno Dom 1689 in sd County within the Jurisdicon of this Court by his certaine bill or writing obligatory sealed with his seal as an Act and deed delivered and here in Court brought whose date is the same day and Yeare did |
