663 Grand Jury called and discharged are by the Court allowed the sume of Three hundred poundes of Tobaccoe for their Expences John Hodges being presented p the Grand Jury and being called to the Bar to Answer the said presentm.t accordingly appeares and the presentm.t as before recited being distincty read the Clerk demanded of him wether he was Guilty as he stood there presented or not Guilty to which he pleaded not guilty and for Tryal put himselfe upon the Country command and was therfore given to the sheerif to cause Twelve good and lawfull men of his Baliwick to come befor this Court by whome the Truth of the p.rmises might be Enquired into which are as Followeth
The Issue being Joyned and the above Jury being duely sworne to Try the same the p.rsentm.t againe is Read and the matter therin contained opened p Hemsley on the behalfe of our soveraigne Lord the King Richard Mason and W.m Crow being sworne as Evidence on his Maj.ties behalfe and the Jury haveing heard the whole Matter on both sides the Court giveth them their charge who withdraw somtime to consider on the p.rmises and returne againe with this Following verdict viz Wee of the Jury doe find John Hodges guilty of forcible Entry and deteiner and the sd John Hodges by Griffith Jones his Attorney moves in Arrest of Judgm.t It is therfore ordered by this Court that Judgm.t be payed and that the Reason therin offered be filed according to rule of Court for fileing declaracons |
