or his order the said sume of Fower hundred and fifty poundes
of Tobaccoe quallified as aforesd att some convenient place
in Chester River upon demand after the date of the same
bill Yett notwithstanding the said Thomas Browne the sd
sume of Fower hundred and fifty poundes of Tobaccoe
unto the sd Thomas Bruff he hath not paid alltho often
demand or but the same to pay he hath denied and refused to
the damage of the said Thomas Bruff Eight hundred
poundes of Tobaccoe and therupon he brings this suit

Issue Joyned as above Betweene the said Plantif and defend.t
which is accordingly performed and are as Followeth

Which said Jury being duely sworne to trie the Issue Joyned betweene
the plt and Defend.t and have heard the Declaracon and plea distinctly
read and likewise the ^Evidence &^ pleadings as well on behalfe ^of y.e plt^ as allso on behalfe
of the Defend.t the Court gives the Jury their charge who withdraw
some time to consider of the p.rmises and ^in^ some smale time returne
and being again distincly called by their respective Names the Plt
and defend.t likewise the Court demands of them if they are agreed
of their ^verdict^ which said Jury Answer they are and likewise it being demanded
who they find for by their foreman answer they find for
the Defend.t and soe they say all

upon which verdict Judgment is Awarded for a Non suit

Therfore it is considered by this Court that the Defend.t Thomas
Browne doe Recover as well the sume of Fifty poundes of
                                                                                    Tobaccoe
