642 And wherupon the said William Clayton and Company by Samuel Withers their Attorney saith that whereas the said Thomas Collins the 16.th day of April 1695 by his certaine bill or writing obligatory sealed with seale as his act and deed delivered and here into Court brought whose date is the same day and Yeare did bind himselfe his Heires Esq.rs and Adm.rs to pay or cause to be paid to the said William Clayton or Com.a his or their Heires Execut.rs Adm.rs or Assignes the sd sume of 880.ll Tobaccoe quallified as aforesaid in Ilye or S.t Michaels River upon all demandes notwithstanding the said Thomas the said sume of 880.ll Tob according to the Tenor of the same Bill to the sd W.m Clayton and Comp.a he hath not paid alltho often demanded but the same to pay hath denied and refused to the damage of the sd William Clayton and Comp.a sixteene hundred poundes of the like Tobaccoe and therupon they bring this suit Withers pledg Jn.o Doe Ri Roe
Both which being Read Judgm.t is Awarded for the same Therfore it is considered by this Court that the Plt William Clayton and Comp.a doe Recover from the Defend.t Thomas Collins as well the sume of Eight hundred and Eighty poundes of Tobaccoe Debt as allsoe the sume of Two hundred Twenty and Three poundes of Tobaccoe cost of suit Simon Wilmer Clk
