641 Which said Jury being duely sworne to trie the Issue Joyned Betweene the Plantif and Defend.t and haveing heard the the declaracon and plea before Recited distinctly read and likewise the pleadings as well on behalfe of the plt as the defend.t the Court giveth them their Charge who withdraw sometime to consider on the premises and then Returne with this Following verdict viz: The Plantif and defend.t being called the Court demands of Jury if they are Agreed of their verdict who Answer therfore and by their Foreman say Wee of the Jury find for the defend.t and soe they said all Upon which Verdict Judgment is Awarded for Non suit Therfore it is considered by this Court that the Defend.t William Hackett doe Recover from the Plantif Edward Offley as the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of Seaven hundred Twenty and Nine poundes of Tobacco cost of suit Simon Wilmer Clk
