Kent fs William Hackett of Kent County stands Attached to answer unto Edward Offley of a plea of Trespasse upon y.e case And whereupon the said Edward Offley by Samuel Withers his Attorney complaineth and saith that whereas the said William Hackett the 20.th day of M.rch Anno 1695 in Kent County within the Jurisdicon of his Court stood justly indebted to the said Edward in the sume of four hundred and Forty poundes of Tobaccoe by an accompt the perticulers therof here in to Court brought the same appeareth in consideracon wherof the said William upon himselfe Assumed and to the said Edward faithfully promised that he the said William the Aforesd sume of 440.ll of Tobacco unto the said Edward when therunto required would well & truely pay Yett Neverthelesse the said William the said sume of Fower hundred and forty poundes of Tobaccoe according to his promise and Assumption aforesd unto the sd Edward he hath not paid Altho often demanded but the same to pay hath denied and refused to the damage of the sd Edw.d 880.ll of Tobaccoe and therupon he brings this suit Withers pledg Jn.o Doe Ri Roe
plt in his declaracon hath sett forth and of this he puts himselfe upon the Country Hemsley Defend.t and the Plt in like manner Withers Command is therfore given to the sheerif to cause In olue good and Lawfull men of Bailiwick to Come before this Court to the [illegible] Betweene the Plt and defend.t which Jury are as Followeth
