Kent fs John Laycock Planter standeth Attached to Answer unto John Hurt and Richard Mason Adm.rs of William Hodges late of Kent County decead of a plea tres su Ca &c.a Whereupon the sayd Jn.o Hurt and Richard mason by Griffith Jones their Atto.rny complaineth and saith that John Laycock stood justly indebted unto the said Hodges for Eighty Gallons of Cyder and Cask sould after the rate of six pence p Gallon and four shillings for the cask which amounts to Two pds four shillings sterl money of England as here in Court by the mouthes of lawfull Evidences wee are ready to Aver Yett the aforesaid Laycock the aforesd sume little regarding to the said Hodges in his life time he did not pay nor to the said Hurt or Mason in their capacities since the deceased aforesaid have not paid but the same alltho often demanded to pay hath wholly refused and denied to the damage of the said Hurt & Mason four pds Eight shillings money sterl of England and therupon they bring ther suit Jones p qr Jn.o Doe pleg Ri Roe But the defd.t not haveing filed any plea to y.e above declaracon Judgm.t is therfore Awarded for the Debt menconed in the declaracon Simon Wilmer Clk And the Defend.t John Laycock by William Hemsley his Attorney moves and Arrest the aforesaid Judgm.t and paryes until To Morrow for fileing his Reasons in arrest of the said Judgm.t which by this Court is accordingly granted Simon Wilmer Clk |
