Kent fs John Davis standeth Attached to Answer unto Jn.o Heathcot of a plea of Trespasse upon the case &c.a Whereupon the said John Heathcot by Griffith Jones his Att.rny complaineth and saith that the said John Davis within the Jurisdicon of ^this^ Court stands Justly indebted unto him the said Heathcot for his commodation Leavy and other goods sould and delivered unto him the said Davis to the full value of Fower hundred and Fowerteene ^pds of Tobaccoe^ the True and Just Ballance of Twelve hundred and seaventy pds of Tobaccoe as by his acc.o here in Court produced may more att large appeare which said sume of Fower hundred and forteen pds of Tobaccoe allthough demanded by the said Heathcot of the said Davis to pay Yett the said Davis little regarding but plotting and contriveing to deceive him of the aforesd sume to the damage of him the said Heathcot Eight hundred Twenty and Eight poundes of Tobaccoe and therupon he bringeth this suit Jones p qr Jn.o Doe pleg Ri Roe
And likewise the Defend.t by William Hemsley his Attorney Demurs in Law to the plt declaracon and prayes Judgment &c.a Hemsley p Defend.t which demurrer being Argued and adjudged to be good in in Law Judgment is Awarded for a Non suit Therfore it is considered by this Court that the Defend.t John Davis doe Recover from the plt John Heathcot as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of Two hundred Forty and Eight poundes of Tobaccoe cost of suit Simon Wilmer Clk |
