his Atto.rny comes and defends the force and
Injury when &c.a and pleads Oyer of the Original Writt
                                            Withers
which being &c.a afterwards pleads non sum in formatus

Therfore it is considered by this Court that the plantif
William Hemsly doe Recover from the Defend.t Thomas Collins
as well the aforesaid sume of seaventeene hundred poundes
of Tob as allsoe the sume of Two hundred Forty and Three
poundes of Tobaccoe cost of suit

Kent fs     John Hunter otherwise called John Hunter of Kent
                County Planter standeth Attached to Answer Gerrardus
                Westels Chirurgion of a plea that he render unto him
                the six hundred poundes of Tobaccoe which unto him
                oweth and unsiestly detains &c.a

And wherupon the aforesd Gerrardus Nestels by Griffith Jones his
attorney saith y.t whereas the aforesd John Hunter the
            as by his obligacon which he the said Westels with the seale of
the aforesaid Hunter signed here in Court brings whose date is the
same day and Yeare did Acknowledge himselfe to Owe to the aforesaid
Westels the aforesd sume of six hundred pds of Tobaccoe to be paid
unto the said Westels the Heires Ex.r Adm or Assignes the full and
just sume aforesd att or upon                                        Notwithstanding
the aforesd Hunter alltho often demanded the aforesd sume of
six hundred pds of Tobaccoe to the same Gerrardus Westels he hath not
as Yet rendred it but the same hitherto hath denied to pay and as
Yett denieth Whereupon he saith he is damnified and damage
hath to the value of Twelve hundred poundes of Tobaccoe and
therupon he bringeth this suit
