James Darby otherwise called James Darby of Kent County Planter standeth attached to answer Peter Peterson of the aforsd County Carpenter of a plea of Trespasse upon the Case Wherupon the sd Peter Peterson by Griffith Jones his Attorney Complaineth & saith that Whereas the aforesaid James Darby somtime in March 1694 borrowed a Certaine sume of Tobaccoe to the value of Eight hundred & did then and there faithfully promise the said Peterson that att the Fall then next Ensueing he would pay the full and Just sume of Fower hundred pds of Tobaccoe when he the said Peterson should therunto require in lue of the Eight hundred pds of Tobaccoe Yett the aforsd Darby his promise and assumption hath not regarded but the same to pay hath denied and still doth denie to the damage of the said Peterson One Thowsand pds of Tobaccoe and therupon he bringeth his sute Jn.o Doe Ric Roe pld Tenor p qr To which the Defend.t not appearing and the Plain.t proveing his accompt as before recited for the sume of four hundred pounds of Tobaccoe Judgm.t is Awarded upon Nihil Dicit Therfore it is considered by this Court that the Plain.t Peter Peterson doe recover from the Defend.t James Darby the sume of Fower hundred poundes of Tobaccoe and cost of suit Simon Wilmer Clk
