557 (285) The p.rsentment as before ratified being Read the said Sarah Smith pleaded not guilty and for Tryal puts her selfe upon God and the Country Command is therfore given to the Sheerif to cause Twelve good and Lawfull men of &ca: to come before this Court to Try the Issue Joyned by M.r Matthew Eareckson on his Maj.ties behalfe and Sarah Smith which Issues are as Followeth viz
Which Jury being duely sworne and to Try the Issue Joyned as before recited and M.r Elias King Charles Tilden and Mary Chandler being sworne as Evidence on his Maj.ties behalfe to declare &c.a The Court and Jury haveing heard the Evidence and pleadings on both sides the Court give the Jury their Charge who depart some time to consider on the prmises and Returne who being called by their Names respectively as before returne this Verdict viz: being demanded by the Clk wether the sd Sarah Smith be guilty as she stands prsented or not guilty the said Jury by their Foreman Answer not Guilty Simon Wilmer Clk Edward Browne of Kent Island being in November last p.rsented p y.e Grand [jury] but declaring to Coll John Hinson and Maj.r Thomas Smith his indisposition of Body it ^is^ ordered that the said presentm.t be continued until next Court Simon Wilmer Clk mr Elias King as attorny of William Bouldin and Thomison his Wife doth acknowledge a Deed to Saml Osborne of Kent Island |
