549 (279) Plea And the Defend.t for plea saith that ther must be a demand of the Debt and a Coppy of the accompt delivered or a Noate signifieing the said Debt and quantitie of Debt as the plt is oblieged by Act of Assembly soe to doe Eareckson p Defend.t None Assumpsitt and prayes it be Tried by the Cort Eareckson And y.e plt likewise Baste p plt Edward Batthurst by his Oath proves he demanded the said Debt and likewise proves his accompt Therefore it is considered by the Court that the plt Edward Batthurst doe recover against the Defend.t Cornelius Comegys as well the sume of Eleaven hundred Forty and One poundes of Tob as allsoe the sume of Three hundred Twenty and five poundes of Tob cost expended in the said suit &c.a Simon Wilmer Clk William Webb becomes bound unto our Soveraing Lord King William the Third &c.a in the sume of Tenn poundes sterl mony of England to be leavied on his Lands and Tenements goods and chattles provided Elizabeth his Wife doe not make her personal appearance att this next Court and in the Meane time be of good abeareing to all his Maj.ties good people to which he gave his consent Sarah Hall being bound by Recognizance to appeare att this Court Leitn.t Coll Hance Hanson offering some reason to the Court and desireing she may find security for her appearance and good abearing until next Court which is accordingly ordered Simon Wilmer Clk
