Therfore it is considered by this Court that the defendant John Power doe recover from the plt James Wroth as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe cost expended in the said suit Simon Wilmer Clk
To which the defend.t by Matthew Eareckson his Attorny pleaded debts of a higher Nature which ought to be first satisfied but makeing no other defence Judgm.t is awarded for the said sume Therfore it is considered by this Court that plts William Hazell and William Norman in their capacity doe recover from the defend.t Sam.l Manthorpe in his capacity the sume of Twenty and Fower pounds sterl and cost expended in said suit Simon Wilmer Clk |
